Chapter 1. The Age of Human Dignity

 

The dictionary meaning of human rights is that ‘the fundamental right in human survival, formally speaking, is the right to be guaranteed first before the constitution, which is the basic law of the state.’

Even though human rights are important as a standard for interpreting laws like this, why do they generally look like picky people when it comes to human rights? Also, why neglect about human rights is the highest value of human dignity in that human rights are the basic rights guaranteed by law on the basis of natural law (natural rights)?

This can be answered by the fact that despite the fact that the great legacy of modern society must be maintained at the cost of the civil revolution, it has lived a harder life with more war and imperialism than in the old days.

This can be attributed to capitalism that aims for the polarization of wealth, such as the polarization of power in the old era, despite the collapse of the absolute feudal system and the establishment of modern democracy based on relativism. This is also serving as a reason for human rights to remain in a declarative sense when interests collide even in the liberal (individualist) system expressed in natural law.

In other words, as liberalism based on paternalistic distribution forms a pluripotentism that encourages polarization, it is inconsistent with the modern spirit based on human dignity.

Especially after the establishment of a modern democratic society based on paternalism, it is true that the expansion of the ruling party was achieved, but it can be understood from the fact that the absolute majority of women are invariably socially disadvantaged like the old era. Therefore, new people who have to live in a global society should live in an active welfare society with a five-to-five gender equality index due to the globalization of the new motherhood based on democratic, welfare, and limited distribution.

Therefore, it will be meaningful to look into the history of Western human rights, which is the result of the civil revolution, which is the basis of today’s concept of human rights.

Liberalism emerged in the 14th century when medieval Europe rejected Hebrism, leaving the dark ages of the 13th century, and the Renaissance based on Hellenism in Ancient Greece. In addition, with the development of natural law and empiricism, a modern democratic society could be established as the Industrial Revolution took place.

Of course, there is a long history of human dignity based on humanism that humans are the subjects of all things in the East. This can be seen from the democratic principle that the people are heaven and the people are kings.

In other words, the ‘Heaven-Earth-Human’ idea based on yin and yang theory is similar in terms of natural law and human dignity in the West, as it is thought that a person is at the center of it as a subject. Thus, relativism, created in reaction to Western absolutism, is the same in terms of modern democracy and humanism in the East, but fundamentally different.

In other words, liberalism (individualism), which is based on natural law that says that people have natural rights as creatures, and democracy, which considers humans to be subjects, not creatures.

This can be understood from the fact that democraticism is an ancient Eastern idea that values harmony with all things in the world, and Western liberalism, which is originated in law, is a rule of law that values only human interactions.

For example, it can be understood from the fact that while the East, which is based on civil fundamentalism, was somewhat balanced between men and women, women were alienated due to discrimination between teenagers and one. In other words, Eastern democraticism recognized the people as heaven and human beings themselves as subjects of life.

This can be understood from the fact that humans have ordered to live the life of so-called who set an example by grinding themselves and cleaning themselves according to their autonomy as subjects.

Therefore, it can be seen that there is a difference from the concept of Western natural rights, which is unconditional rather than the conditional East. 1.1 Realizing the idea of natural law

Modern society was formed as a result of the civil revolution, in which 18C natural law thinkers John Locke, Russo, and Montesquieu theorized about social contracts and natural human rights, followed by capitalism formed by the Industrial Revolution.

As such, women at that time were capable of actively participating in the revolution for women’s liberation, and there was a clear sense of human rights, but women classified as passive citizens had a hard life due to housework and childbirth.

Marriage was only possible within the same social class, and the exclusive consciousness of the other classes dominated all relationships. 1.2 Implementation of the Declaration of Human Rights

The human rights declaration of freedom, equality, and philanthropy, which were the causes of the civil revolution, provided an opportunity to prove that human beings were human nature is good orientation and to establish a modern society, a great legacy of mankind.

In other words, it is a human victory that laid the foundation for realizing human dignity. Capitalism was, of course, modified by the success of the October Revolution of 1917 in Russia when communist society emerged as a reality. This was due to the removal of representative democracy and pluralist party systems, and the nationalization of land or means of production as a planned economy, resulting in a successful industrial revolution that was slower than Europe.

In other words, as an example of a socialist welfare state, it was on the verge of spreading to neighboring countries and collapsing the capitalist system.

After the establishment of modern society, there have been many trials and errors from early capitalism (liberalism), which focuses on human individuality, to modified capitalism that respects human sociality.

This can be attributed to too many conflicts of desire to achieve wealth in the mammonism order, where money became a character, after the status system formed by the power or personality of the absolute feudal system was expelled.

2.2 The emergence of outstanding women

Adams declared in 1783 that women do not have to abide by the Republican Constitution if the New Constitution of the United States does not recognize women’s right to vote. And black people who suffered extreme racism after the Civil War also had suffrage.
